Lucknow: The Yogi government of Uttar Pradesh is going to make significant changes to the UP Madrasa Act, after which madrasas in the state will no longer be able to award Kamil (graduate) and Fazil (postgraduate) degrees. This is because the Yogi government is preparing to amend the Madrasa Act, limiting its scope to the 12th grade.
A proposal for the amendment is being prepared at the government level. The Supreme Court had also raised questions about the degrees of these classes under the Act. Since then, the Yogi government has been preparing to amend the Madrasa Act.
It is noteworthy that recently, the Supreme Court overturned the decision of the Allahabad High Court and stated that all provisions of the UP Madrasa Act do not violate the basic structure of the Constitution.
However, it also said that madrasas awarding Kamil and Fazil certificates beyond the 12th grade cannot be recognized, as higher education operates under the UGC Act, whereas the Uttar Pradesh Madrasa Education Council Act of 2004 defines the powers of the council. However, the Supreme Court upheld the constitutional validity of the Madrasa Education Council Act.
It is also mentioned that under the Uttar Pradesh Madrasa Education Council Act 2004, the Madrasa Board was tasked with conducting exams for the courses of Munshi, Maulvi, Aalim, Kamil, and Fazil.
Based on this Act, the Uttar Pradesh Government Arabic and Persian Madrasa Recognition Administration Rules 2006 were formulated. Now, to comply with the Supreme Court’s order, the government will remove all provisions related to the Kamil and Fazil courses from the Madrasa Act. The revised regulations will now be limited only to the 12th grade.
